Terms and Conditions - Laplow Imaging - see also terms and conditions for use of LaplowImaging.co.uk
Please read the terms and conditions carefully before using the LaplowImaging.co.uk website. By using the LaplowImaging.co.uk website, you signify your agreement to be bound by the LaplowImaging.co.uk conditions here. In addition, when you use any current or future LaplowImaging.co.uk service (eg: purchase photographic print, commission photographer, commercial use of images etc.), you will also be subject to the guidelines and conditions applicable to that service.
The following terms and conditions of trade with Laplow Imaging are supplementary with the terms and conditions of using LaplowImagingco.uk - further details here.
Definitions ‘Photographs’ means all photographic material furnished by the Photographer, whether transparencies, negatives, prints or any other type of physical or electronic material. The ‘Photographer’ means Andrew Cooper (trading as BECO DPW). The ‘Client’ means the individual/s, partnership, company or organisation who commissions the Photographer, places an order for reprints or other form of trade with the Photographers. The ‘Commission’ means a direct commission for work, commercial, social, sport, freelance, wedding, portraiture or other photographic work.
Acceptance On commissioning the photographer (whether a direct commission for work, commercial, social, sport, freelance, wedding, portraiture or other photographic work) to undertake the work required or placing an order for reprints (please also see the terms and conditions for ordering reprints via LaplowImaging.co.uk here), the client is deemed to have accepted and will abide by these terms and conditions.
Copyright The entire copyright in the Photographs is retained by the Photographers at all times throughout the world. By commissioning the photographer (as per ‘Acceptance’) or ordering photographic reprints, the client agrees not to breach the copyright held in the photographs.
You are purchasing the photograph or image only, not the right to use or reproduce it. To copy, scan, reproduce, republish, upload, post, transmit, distribute, publicly display or to use any image you will need written permission from us.
The images are provided to the recipient as is. All implied warranties are hereby disclaimed, including, without limitation, the warranties of title, infringement, merchantability, and fitness for a particular purpose. To the extent that images include any trade name, trademark, or service mark owned by a third party, the user is responsible for obtaining appropriate permissions and licenses from such third parties.
Commercial Use of Photographs A Client may request the commercial use of a photograph. Commercial use of photographs will be governed by the issue of a Licence to Use agreement for the specified photograph/s. The Licence to Use shall govern the use of the image, media, territory, length of use and whether the image will be exclusive to the client and for what period. Commercial use of images will be chargeable and subject to negotiation. At no time is the copyright assigned to the Client (see ‘Copyright’ above for additional information).
Client Confidentiality The Photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to him in confidence for the purposes of the photography, save as may be reasonably necessary to enable the Photographer to carry out his obligations to the commission.
Payment Payment for photographic reprint orders will be expected at the time of ordering; orders are not taken offline and no credit accounts are given, except for Commercial clients; in which the terms are strictly thirty days net.
A fifty-percent non refundable* deposit (*see below ref. cancellation) is payable by the Client on placing a booking prior to the photographic commission for weddings and portraiture; the booking is not firm until the deposit has been received and has cleared.
If less than seven days notice is given of the need for the photographs to be taken, then a cash deposit is payable by the Client on the day of the booking. For wedding photography the full payment of the chosen wedding package is required.
All orders for reprints (via LaplowImaging.co.uk)require full payment by the Client on the order being placed; see the terms and conditions of LaplowImaging.co.uk.. Orders are not accepted offline by mail order.
Cancellation If the Client cancels the booking more than one month prior to the date of the photographs are to be taken the deposit is refundable, at the Photographer’s discretion, on the following scale:
More than six months prior: Fifty percent Three to under six months prior: Twenty-five percent Less than three months prior: Ten percent
Rejection Unless a rejection fee has been agreed in writing in advance, there is no right to reject on the basis of style or composition. No photograph shall be deemed more important than another, and special requests are not binding instructions. The Photographer’s judgement regarding the locations, poses and number of images taken shall be final.
Electronic Storage Photographs may not be stored in any form of electronic medium without the written permission of the Photographer. Manipulation of the image or use of only a portion of the image may only take place with the written permission of the Photographer.
Credit The Photographers’ name (Laplow Imaging) shall be printed on or in reasonable proximity to all published reproductions of the Photograph(s). The Photographers’ assert their statutory right to be identified in the circumstances set out in Sectons 77-79 of the Copyright, Designs and Patents Act 1988 or any amendment or re-enactment thereof.
Applicable Law This agreement shall be governed by the laws of England and Wales.
Variation These Terms and Conditions shall no be varied except by agreement in writing.
